Anti-Spam Policy

Unbounded Pioneering Inc. has a no tolerance spam policy for its Senditly service. "Spam" means unsolicited communication to people with whom our customers do not have a business relationship or who have not specifically requested (opted in to) our customers' mailings.

We monitor Senditly for unusual spikes in sending volume. A user's account will be terminated if the user sends unsolicited email messages. Please report any suspected abuse to [email protected]. Forward the complete email in question, including headers. If you no longer wish to receive emails from the sender, please unsubscribe using the link at the bottom of the message. We will take the appropriate action against the sender.

To use Senditly, you must send only email for which recipients have either given prior consent or been clearly notified of your opt-out process. Senditly allows you to configure either opt-in or opt-out mailing lists, and you are responsible for choosing the method that complies with your local laws. If you rely on opt-out, you must inform recipients of this in advance.

An opt‑in can occur via a sign‑up form on a website, at a point‑of‑sale sign‑up form, or on a physical sign‑up sheet. Purchased lists may not be used with Senditly, regardless of their source or permission status.

You may not use Senditly to:

  • Purchase lists (whether they are opt‑in or not)
  • Have a subscription form that subscribes users to an unrelated list
  • Send out unrelated offers or unrelated content to your newsletter list
  • Add an email address into a list without the subscriber's permission

You may:

  • Send out a regular newsletter to recipients who have opted in to receive it
  • Send information and content to recipients who have requested it from your organization
  • Send user triggered emails that result from actions carried out on your website

Opt-In vs. Opt-Out

United States law (the CAN-SPAM Act) allows marketing emails to be sent until a recipient opts out, while Japan's Act on Regulation of Transmission of Specified Electronic Mail generally requires prior consent. Senditly lets you select either approach. Choose opt-in or opt-out at your own responsibility and in compliance with local regulations. If you use opt-out, make that choice clear to recipients before sending them marketing messages. Transactional notices triggered by user actions, such as purchase confirmations, may be sent without separate opt-in in either jurisdiction, but every message must include a simple unsubscribe method when legally required.

Procedure for handling complaints

Your account will be immediately terminated if we determine in our sole discretion that you send spam. If you use Senditly to send emails to addresses obtained in any way other than a subscriber opting in to your list, you may incur a USD $100 charge per substantiated incident in accordance with state and federal regulations.

To determine whether you have sent spam we will:

  • Review the content of the message in question
  • Review your subscriber list for patterns common to harvested lists
  • Review the spam complaint
  • View the records to see when the subscriber was subscribed and their IP address

Prohibited content

Unbounded Pioneering Inc. prohibits the use of Senditly to send content which:

  • Provides, sells or offers to sell child pornography, escort services, illegal goods, illegal drugs, pirated software, or instructions on how to make weapons
  • Provides, sells, or offers to sell or rent any mailing list
  • Displays material that exploits children or discloses any personally identifying information about children
  • Provides material that is abusive, bigoted, prejudiced, racist, hateful, profane, obscene, violent, harassing, fraudulent, deceptive, misleading or otherwise illegal
  • Violates the copyright, trademark, patent, trade secret, intellectual property or other rights of another
  • Sells or promotes products or services that are unlawful in the location at which the content is posted or received
  • Introduces viruses, worms, harmful code or Trojan horses on the Internet
  • Promotes, solicits or participates in pyramid schemes
  • Engages in any libelous, defamatory, scandalous, threatening or harassing activity
  • Posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in carrying out such violence

We reserve the right to prohibit the use of Senditly by any entity at our sole discretion.
